Government Relations Update – Salary Cap Waiver

Language from the first set of budget bills was released last night. The salary cap waiver for retirees was extended for two more years!
**A Note from SAANYS Legal Department**
Please be advised that the New York State and Local Retirement System as well as the New York State Teachers Retirement System are scrutinizing the use of such waivers. Be advised that there should be a clear separation from employment of at least two months between the date of retirement and the date that the retired employee returns to the school district or BOCES. Also, there should not be any documented communications about returning to work from your prior school district.
