LAWS OF NEW YORK, 2021 CHAPTER 167 1 AN ACT providing that a student enrolled in an individualized education 2 plan during certain school years may continue to receive educational 3 services until the student completes the services pursuant to the 4 individualized education plan or turns twenty-three years of age, 5 whichever is sooner; and to provide for the repeal of such provisions 6 upon the expiration thereof 7 8 Became a law June 29, 2021, with the approval of the Governor. 9 Passed by a majority vote, three-fifths being present. 10 11 The People of the State of New York, represented in Senate and Assem- 12 bly, do enact as follows: 13 14 Section 1. Notwithstanding any provision of law, rule or regulation to 15 the contrary, a school district may provide educational services in the 16 2021-22 and 2022-23 school years to a student who turned twenty-one 17 years old during the 2019-20 or 2020-21 school years and was enrolled in 18 the school district and receiving special education services pursuant to 19 an individualized education plan. Such student may continue to receive 20 such educational services until the student completes the services 21 pursuant to the individualized education plan or turns twenty-three 22 years of age, whichever is sooner. 23 § 2.
